Many states have passed laws allowing home care agencies and nursing homes to check the criminal histories of prospective and current employees. In doing so these agencies are reported to have found out that a high number of workers had committed crimes, and the number of such has a tendency to be rising. The other states still do not have similar laws.

In one of California counties alone over 15% of prospective in-home support service employees were found to have criminal records. In Texas 9% of applicants in 2000 were found to have convictions. In New Jersey the 2003 check up revealed 400 current employees who committed disqualifying crimes. Some of them had been working for years.

Perspective of possibly hiring people who have past criminal histories means potential threat to frail clients, especially considering that the majority of caregivers spend extended unsupervised time with frail, isolated seniors alone...
